A Mandan man has been arrested for provoking a Bismarck K-9 Saturday night outside of the Elbow Room.

Around 12:30 a.m. on Saturday, Bismarck Police say 24-year-old Nicholas Demetres was heavily intoxicated and told to leave Elbow Room by security and police. The affidavit states Demetrus refused to leave the property and became agitated.

The BPD K-9 handler says Demetrus was informed that there was a Police K-9 inside of the vehicle and was told to stay back.

Demetrus walks to the back of the kennel, and punched the window. The affidavit says the vehicle was clearly marked as a Police K-9 Unit.

He was arrested for provoking a K-9 unit.

Later at the hospital, while being medically cleared due to being intoxicated, Demetres lifted his head toward the officer and spit on his arm.

Demetres is being held at the Burleigh County Detention Center for contact by bodily fluids and harassment of law enforcement support animal.
