A 61-year-old Wahpeton man has now been charged in the death of his nephew.
James Bynaum Jr. is facing one felony count of negligent homicide after court documents say he killed 42-year-old Oscar Charles Bynaum.
Court documents say in the early morning hours of Nov. 29, Bynaum Jr. and his nephew got into an argument at their apartment at 716 6th St. S. Documents say Oscar was punching holes in the wall and eventually he and his uncle, Bynaum Jr. started physically fighting.
Documents say Bynaum Jr. put Oscar in a choke-hold and Oscar's body went limp. Bynaum Jr. then left the apartment and no one checked on Oscar until the following afternoon when police were called for an unattended death.
The medical examiner's preliminary findings say Oscar's death is consistent with being strangled.
Bynaum Jr.'s bail has been set at $10,000 cash only.
