ND Asks Federal Court To Throw-out Same Sex Marriage Ban Suits

Posted: Updated:
North Dakota's attorney general is asking the federal court to throw-out two lawsuits challenging the state's gay marriage ban.

Attorney General Wayne Stenehjem filed his response in federal court today.

Seven couples sued in June, contending the ban is unconstitutional.

The second suit, filed by another couple, also goes to the issue of the recognizing same-sex marriages performed elsewhere than North Dakota.

In his response, Stenehjem says, "redefining marriage as genderless would be contrary to public interests promoted by marriage."

His response also says North Dakota law does not violate the 14th amendment.

North Dakota is the final state to face a legal challenge of its gay marriage ban.
