Moorhead Hockey Player Accused in Sex Tape Case Released without Bail

One of two USHL hockey players, accused in a case involving a sex tape with a 15-year-old girl in a Moorhead hotel, appeared before a judge.

Thomas Carey, who is from Moorhead, walked into his first court appearance in Clcay County Court Thursday morning with his lawyer Bruce Quick.  The judge decided not to set a bail as long as he does not contact the victim, appears at his next court date, and stays in contact with his attorney.

Carey and Brandon Smith played for the Lincoln Stars at the time of the alleged crime. The pair is accused of using a cell phone to record one of them having sex with the underage girl and sending it to teammates. Carey and Smith are facing three felonies each, including possession of child pornography.

Carey's attorney says they will aggressively defend this case.

"If you look closely at the statement of probable cause, which was filed with the charging documents, you'll note what charges the case has not brought and you're going to ask yourself why that was. And I think if you look at the remaining charges, the evidence will be pretty clear that the law that was drafted for those allegations did not intend to apply to these facts," explains Quick. 

Carey will appear back in court on August 11 and his attorney says the process has been tough for his client.

"He's doing fine, he's very upset obviously by these allegations. This is a very, very nice young man and a nice family, I think that will be obvious as this process goes forward," Quick said on Thursday.

Smith is scheduled for his first appearance July 29.
