No Licenses Required For E-Cigarettes

Posted: Updated:
Electronic cigarette shops are popping up all around the Fargo Moorhead area and why shouldn't they? There is no licensing required to sell popular product.

"As of right now the only thing we had to do was form a corporation and get a sales tax permit," says Sports Vape Owner Darius Endres.

There are 3 specialty shops dedicated for E-cigs in Fargo but there are various tobacco shops that sell them as well.

"There is a lot of money to be made, it has been popular since 2009," say Endres.

Both Minnesota and North dakota, state law allow electronic cigarettes to be sold without tobacco licenses unless cities say otherwise.
even many selling the products think licensing and regulations are needed.

"I prefer it to be done because you don't want a ma and pa shop opening up and making their own juice and hurting people," Says Smokes 4 Less Manager Joe Waswas.

Since the is no licensing when it comes to e-cigarettes, the only regulation is to not sell their products to minors.

"We choose to get material that says we card everybody," say Endres.

The F.D.A. is proposing new regulations that would include ways to eliminate sales of E-cigs to minors by not allowing them sold in vending machines and require manufactures to put health labels on the juice additives.

Right now licenses are not required to open an E-cig shop in Fargo or Moorhead. West Fargo does require a tobacco license from the state to sell electronic cigarettes in their city.
