Bemidji State Football Player Charged with Criminal Sexual Conduct

A member of the Bemidji State University football team was charged with 3rd degree Criminal Sexual Conduct in Beltrami County Court on Wednesday.

  Joshua Riley Malone allegedly had sex with a woman, who was mentally impaired or rendered helpless. If convicted, he faces up to 15 years in prison and a $30,000 fine.

  According to court records,  the female victim had been playing drinking games at Malone's house during a February party, when she became highly intoxicated. Malone told police that he carried the drunk woman to his room to take care of her.  In a statement to Police, Malone said they had sex. But,  Malone says the victim was not unconscious at that time.

  A spokesperson for the Athletic Department says, Malone has been suspended from the Bemidji State University football team, pending the outcome of the investigation.
