Attempted Murder Charge Dropped In Stabbing Case

MINOT, N.D. (AP) - An Arkansas man detained for nearly a year and a half has been released from a North Dakota jail after an attempted murder charge was dropped due to a lack of evidence and the credibility of witnesses.

The Minot Daily News reports (http://bit.ly/YJsJXC) that Thomas James Mashburn was set to go on trial Monday. Instead, he left on a flight to Arkansas Friday morning to reunite with his wife and four daughters.

Mashburn had been accused of stabbing another man in the throat outside a Minot bar over the 2011 Labor Day weekend.

Ward County assistant state's attorney Sean Kasson filed the motion to dismiss on Thursday.

Mashburn's attorney, Kerry Rosenquist, says the physical evidence at the scene did not coincide with what witnesses were saying.
