The U.S. Consumer Product Safety Commission (CPSC) filed a formal administrative complaint* against Baby Matters, LLC on Thursday in the wake of five reported infant deaths tied to the company’s products. The complaint applies specifically to two items manufactured by the Berwyn, Pennsylvania based company – Nap Nanny and Nap Nanny Chill infant recliners. The report, CPSC Docket No. 13-1, alleges Nap Nanny Generation One, Generation Two, and the Chill infant recliners have flaws in their design, warnings, and instructions, which lead to a “substantial risk of injury and death” to infants. Philadelphia personal injury attorney Richard P. Console Jr. applauds the CPSC for moving to address safety concerns and correct them, but cautions that more victims could be out there.
“The number of reported complaints and injuries attributed to these products is definitely a cause for concern,” said Console. “The CPSC is the public’s first line of defense in making them aware of dangerous products and forcing manufacturers to protect the consumers who purchase or use them. Even one child dead as an alleged result of using products designed for them is one too many.”
As of December 2012, the CSPC* is aware of 70 incident reports involving children nearly falling out of the products identified in the complaint. Four infants have reportedly died while using Nap Nanny Generation Two recliners while a fifth allegedly died while using the Chill model. The complaint,* filed after a unanimous vote by Commission officials, demands an order requiring Baby Matters, LLC to give a full refund to consumers who purchased the named products and issue a warning notifying the public of the existing defects. Talks between the company and CSPC officials reportedly failed to yield positive results in moving toward a voluntary recall, which led to the government filing its complaint.
The crux of the CSPC’s complaint* is the three-point harness used in both recliners to secure toddlers to its foam base. The CSPC alleges that, despite improvements to the design, safety issues still remain with children falling or hanging dangerously from the recliners as evidenced by the number of alleged deaths. According to the complaint, the company sold about 5,000 Nap Nanny Generation One and 50,000 Nap Nanny Generation Two recliners from 2009 through 2012. Baby Matters, LLC has sold more than 100,000 of its Nap Nanny Chill recliners since January 2011.
