No Charges in Crash that Killed Bemidji Man

Police say charges are not expected in the car-pedestrian crash that killed a Bemidji man.

Last Saturday, August 25, the Beltrami County Sheriff's Office says a man was hit by a car near Balsam Road on Irvine Avenue in Bemidji, Minnesota. When police got there, Tyler Blake Cummings, 21-years-old of Bemidji, had been struck by a car and died at the scene from his injuries.

The investigation shows that Cummings was at a bar with friends before the accident. His friends left, called Cummings a taxi, but he chose to stay until almost 1:00 a.m.  Police believe Cummings walked to the location of the accident and was laying on the road when he was hit by the car.

The car was driven by Samantha Pender, 19-yeras-old and also from Bemidji. Pender and those in her vehicle were not injured in the crash.

The investigation shows Pender was on her way home from work after picking up her child when the accident happened. Witnesses say they saw Pender swerve to avoid hitting Cummings, but she didn't have enough time. Police say there were also skid marks at the scene that indicated she tried to stop.

Pender had not been drinking the night the accident happened and investigators say charges are not expected.

Preliminary autopsy results on Cummings indicate his blood alcohol level was 0.161%.  Additional toxicology tests are being conducted by the Ramsey County Medical Examiner's Office. Funeral services for Tyler Cummings are Friday at 10:00 a.m. at the Solway Bible Church in Solway.
