Court orders new sentencing for 2nd time

An appeals court that ordered a new sentence in November for a convicted drug dealer in North Dakota has now decided that the sentence should be overturned.

Darrin Raysor originally was sentenced in August 2010 to 52 months in prison after he pleaded guilty to distributing cocaine. He received credit for eight months served on state charge.

The 8th U.S. Circuit Court of Appeals ruled on appeal that Raysor should not have been given the eight-month break and ordered that he serve the full five years.

The newest ruling cites updated federal rules that have increased the drug amounts for mandatory minimum sentencing. Those rules were not in effect at the time of the last appeal.

The 8th Circuit has sent the case back to district court for another re-sentencing.
