Deputy prison warden wins job back

North Dakota's Supreme Court says a deputy state prison warden who was fired for sexual harassment must get his job back.

The court's ruling says Robert Heier (HY-ur) was improperly disciplined twice for the same wrongdoing. The court says he's entitled to reinstatement and almost three years' back pay.

Heier got into trouble in April 2009. He grabbed the backside of a female prison employee at a music show and said he would have her fired if she told anyone.

Heier was suspended from his job for a day.

The employee said later the punishment wasn't strong enough. The case was reopened and Heier was fired.

The Supreme Court's ruling says North Dakota law doesn't allow for a state employee to be punished more than once for the same misconduct.
