Fargo gay couple turned away

A Fargo couple is contemplating their next move after being turned away for a marriage license at Cass County courthouse.  
They knew they would be. That's because they're both men, and the law in the state of North Dakota doesn't allow them to marry.
Lenny Tweeden and Wayne Rosell, who've been together more than two decades, braved the long walk through the courthouse halls that all about-to-be-married couples do.
Unlike them, they knew they'd have to come back.
Tweeden says he's been an activist for other causes.  
For this one, he says, the timing is right.
"Washington is about to become the seventh state to legalize it, and also Prop 8 may be going to the supreme court. And that may affect the nation," says Tweeden, referring to California's bill outlawing same-sex marriage. It was recently ruled unconstitutional by the 9th Circuit Court of Appeals.
The Cass County State's Attorney says he isn't sure just how the couple could try to challenge the laws prohibiting same sex marriage.  
He thinks it might be best taken to the state legislature.
