Fort Totten man serving life for 2016 slaying loses appeal

BISMARCK, N.D. (AP) — A Fort Totten man serving life in prison for a killing on the Spirit Lake Indian Reservation two years ago has lost an appeal.

Dallas Thundershield was convicted of fatally stabbing 52-year-old Richard DeMarce in the heart on April 9, 2016, and critically injuring another man. Authorities said he used his vehicle, his booted foot and a knife as weapons during a fight.

Thundershield appealed to the 8th U.S. Circuit Court of Appeals, arguing that evidence in the case was insufficient and that the district court erred by allowing evidence of a prior conviction in tribal court.

Appeals court judges rejected the arguments, saying in part that "the evidence against Thundershield was overwhelming on all counts."
